Judge Nap: If He Believes an Attack Is Imminent Trump Has the Authority to Attack First

‘The president does not need expressed authority from the Congress to take out missiles or to engage an offensive weaponry’
By Grabien Staff

EXCERPT:

NAPOLITANO: "I want to clarify what the law is, if I could. To your question, the President doesn't need — in my opinion, he should have it, but that’s not the law — the President does not need expressed authority from the Congress to take out missiles or to engage an offensive weaponry. If he believes that an attack on American interests — that could be South Korea, Japan, Guam, Anchorage or Los Angeles — is imminent, he could attack first for 90 days before he even has to go to Congress under the War Powers Act."
